PLATAFORMAS ELEVADORAS MAQEL, S.L acts not only as controller of personal data in the various processes and systems that are applicable or in use within PLATAFORMAS ELEVADORAS MAQEL, S.L, but also as processor where we can come into contact with the personal data of our customers that we process at your request. As a processor we provide a data processing agreement in accordance with the law that must be read and signed by both parties.

PLATAFORMAS ELEVADORAS MAQEL, S.L is the exclusive distributor of JLG Industries for Spain and Portugal. It specializes in the sale and operational leasing of JLG lifting platforms, a worldwide reference. As a distributor of leading brands in its sector, we offer solutions to our customers: new equipment, used equipment, official technical service, spare parts, training, financing,...; everything you are looking for in a solution provider with coverage throughout the Spanish and Portuguese territory.

2. What personal data do we collect?

Personal data" means all information relating to an identified or identifiable person.

We receive and process data from customers/suppliers/partners/visitors online or on the site, etc. (i.e. interested persons) in the context of a collaboration or future collaboration (prospecting).

These "Personal Contact and Identification Data" are:

The personal information we collect is appropriate and relevant to our purposes. We limit the collection of your personal data to the minimum amount necessary for the purposes for which we process personal data.

3. Why do we collect personal data?

We collect your personal data to the extent necessary to fulfil any agreement you have entered into with us or, at your request, to take the necessary steps to reach an agreement with us.

We need this information for the normal development of our business activities and for the provision of our services. According to RGPD, this corresponds to the "legitimate interest" and "contractual obligation" of the data controller.

All personal data (general identification data) will only be used for the following purposes:

5. How long do we store your data?

Personally identifiable data is kept as long as the partnership exists and neither party terminates it. As a data subject, you can explicitly request that it be deleted earlier, but without violating the legal retention periods (e.g. 5 to 10 years for personal data required to be stored in accordance with tax laws, 3 to 10 years for personal data required by either party to defend its legal rights in court, etc.).

6. Recruitment and Selection

In order to provide the best possible employment opportunities, we need to process certain information about you. We will only ask for information that we believe will allow us to truly help you, such as your name, age, contact information, educational background, professional history, emergency contacts, immigration status, psychological profile, intellectual abilities, and social security number (and, of course, you may choose to share other relevant information with us). When necessary, and in accordance with local laws and requirements, we may also collect health-related information, diversity information, or information about a criminal conviction.

We obtain your personal information from third parties (for example, through professional networks, job aggregators, and workplace providers).

Whenever you access our website or read or click on a link in an email from us, we will also collect certain information automatically or through you when you provide it to us.

In the event that you are a temporary worker, we also collect your personal data:

From third parties (for example, employment agencies).

In the event that we employ you or hire you directly as a temporary worker, the primary reason for using your personal data is to ensure the proper functioning of our temporary relationship and to fulfill our contractual and other obligations to each other and to our customers, and to fulfill our obligations to third parties, including tax authorities and government agencies.

7. With whom do we share your data?

7.1. We do not sell or transfer your data to persons or companies that are not part of the Mateco Holding group.

We do not share your personal data with third parties, except when at least one of the following conditions is met

we have received your prior consent to do so
the recipient is our sub-contractor/supplier/affiliate and it is necessary to share your personal data with them for the purposes detailed in section 3 above.
we are performing pre-contractual activities to offer you our products and services
we are performing the services you purchased from us
we are obliged to do so in the context of a legal regulation or procedure (see 7.2)
we are requested to do so by legislative or judicial authorities (see 7.)

For the processing of your personal data we may use third parties who will receive your data. We require these third parties, such as processors, to treat your data in accordance with our instructions and (safety) regulations. We record these agreements with each processor in the so-called Data Processing Agreement.

Some of these processors may be located outside the EU. If this is the case, we will ensure that we have concluded additional agreements with these third parties in order to guarantee an adequate level of protection.

7.2. In the event of a total or partial reorganization or transfer of PLATAFORMAS ELEVADORAS MAQEL, S.L activities, by means of which it is reorganized, transferred, ceases its commercial activities or if PLATAFORMAS ELEVADORAS MAQEL, S.L files for bankruptcy, this could imply that your data are transferred to other entities or third parties through which PLATAFORMAS ELEVADORAS MAQEL, S.L commercial activities are carried out in whole or in part.

Access by third parties

8.1. For the processing of your personal data, we may allow third parties access to your personal data.

8.2. In that case, we guarantee you the same level of protection under this Privacy Policy so that contractual obligations are enforceable with respect to these employees and co-workers.

Social networks

Through the web and (our own) social networking channels, we like to engage in dialogue with customers, users of our services/applications and website visitors regarding our organization, products and/or services. The purpose is to provide useful and meaningful information and/or answer questions they ask us through social media. We actively follow Internet and social network channels such as Facebook, Instagram, Youtube, LinkedIn and blogs. We expressly reserve the right not to respond to every question or comment. No rights can be derived from whether or not we respond to the content.

It is possible that by participating in web sources and by answering questions or comments, we may obtain (personal) data. Of course, we will treat this data in accordance with this privacy statement. We are not responsible for the content that other users of social networking channels post or how they treat personal data.

10. Automatic decision making and profiling

We can elaborate profiles. Profiling is the collection, analysis and combination of (personal) data in order to classify you in certain categories. For the elaboration of your profile, the profiling algorithm can, in theory, include all relevant data types mentioned in point 2. Once data is obtained, analyses are performed to ensure that we automatically add certain categories to your profile. In this way, the creation of profiles ensures that both the content of our websites, applications, emails, offers and advertisements are better suited to your interests.

In terms of organization, we have a privacy statement and clearly defined responsibilities and authorities. We also have the necessary processes and procedures in place to optimally execute and enforce this policy.

By linking us with those in charge of processing, the security of your personal data is already guaranteed by contractual agreement.

12. Use of tracking devices and telematic services

Our devices can be equipped with tracking devices that send GPS and telematic data in real time to PLATAFORMAS ELEVADORAS MAQEL, S.L.

We collect the following technical data (related only to the connected machine) through the GPS tracking devices:

Geolocation data: especially the last known location, latitude and longitude of the site (e.g. in case of theft);
Usage data: in particular the number of hours the machine has been used (for billing purposes), speed, distance,
Component data: in particular engine coolant temperature, engine oil temperature, engine oil pressure, ambient temperature, engine fault codes, transmission fault codes, fuel level,...

These data are collected through devices and services made available to us, managed and maintained by the manufacturers of the machines or by specialized third party suppliers located in the EU and the USA. Therefore, your access to your personal data is inherent and the security of your personal data has been reinforced by contractual agreements between us and them.

13. What are your rights and how can you exercise them?

You have the right to ask us to view, correct or delete your personal data.

You may also notify us of your wish to exercise your right to limit the processing and transferability of your data or to oppose the processing thereof.

These rights can be exercised free of charge by sending a clear request to that effect to our privacy e-mail address notificaciones(at)maqel.es, in which you must explicitly indicate which right you wish to exercise, together with an explanation, a copy of your identity document and the way in which we can contact you.
